Florida man wins home foreclosure fight

There may be nothing more unsettling than to have authorities show up at your house telling you need to be out because the home has been foreclosed on. This can be especially upsetting when someone is in the midst of working with the bank and trying to obtain a loan modification to keep their home safe from home foreclosure. For one Florida man, this very scenario played out and he had to fight to stay put even though he had filed everything he needed to file to stay in his home.

The 71-year-old man became overwhelmed with medical bills after his wife died from cancer. He fell behind in his house payments and was facing foreclosure. The man reached out to the bank to apply for a home loan modification.

The bank cites that one department was essentially dealing with the loan modification aspect of the house while the other department was processing the home foreclosure action. The move to foreclose was supposed to legally stop when he applied for a loan modification. The foreclosure went through as modification paperwork was being processed.

The mix up was resolved, and the man is able to stay in his Florida home for now. There have also been other cases where people have gone through home foreclosure when there were loan modification applications simultaneously being processed.
